This week's video series continues the discussion of how to spot illegal non-competition provisions hiding in your employment contract. This week looks beyond Ontario where non-competes have not been banned by legislation, but there are still strict common law rules that apply. The topics covered this week were:
temporal scope limitations;
geographic scope limitations;
business scope limitations;
saving provisions (that try to get around mistakes in the non-compete); and
what to do when you spot an illegal non-compete in your agreement.
